When you purchase the Color Lingo Trainer’s Kit you are agreeing to the terms of its End-user License Agreement (EULA). This EULA is a legal agreement between you (either individual or single entity) and Mary Miscisin. By downloading, printing, or otherwise using the Licensed Product, you agree to be bound by the terms of this EULA. When you purchase the kit, YOU MAY: (Grant of License: This EULA grants you the following rights)

1.    Reproduce participant  handouts to use in your presentations (paid or unpaid presentations)

2.    Alter the “editable” PowerPoint Presentation to suit your needs, including changing text, pictures, etc.

3.    Alter the training format to suit your specific audience - you may use the handouts, activities, or PowerPoint in any order, any combination, and any time frame.

When you purchase the kit, YOU MAY NOT: (This EULA requires that you abide by these use restrictions:)

1.    Post any of the content of the kit on any website for any purpose.

 

2.    Distribute any part of the Trainer's Manual to any other party – only the handouts are distributable.

 

3.    Resale, distribute, or in any other way use the kit materials other than to support your own presentations.

 

4.    NOTE: You DO NOT have the right to publish, market, sublicense, reprint, resale, “give away” as a “bonus”, or otherwise distribute this kit (for fee or no fee) other than what is cited in the “You May” section.

5.  Give certification trainings, "train-the-trainer" trainings, or in any other way transfer rights of this material or any of it's derivatives to another party.

Termination of License.

1.    Mary Miscisin reserves the right to terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Licensed Product including product data, associated media, and all documentation materials in printed, electronic or any other form.

Refunds.

1.    This product is covered by a 30 day money back guarantee from the date of purchase. In the unlikely event that you choose this option, the rights of the kit are immediately revoked. Any distribution of kit material after a refund is a copyright violation and will be prosecuted to the full extent of the law.

Ownership of Licensed Product.

1.    The Licensed Product and all associated elements such as copyrights, trade names, intellectual property, and information with respect to the Licensed Product are owned by Mary Miscisin.

Copyright

1.    The Licensed Product is Copyright 2006 by Mary Miscisin by the US Copyright office. Any unauthorized use of the Licensed Product is in violation of Copyright law and will be prosecuted under the full extent of the law.
